DATE IN: DATE OUT: MAXIMUM OCCUPANCY = 8 PERSONS
Premises/duration/rate-Owner/Agent - shall provide lodging in Ocean City Maryland to the guest at the premise for the period and at the rate identified above. Check-in time is 3pm and Check-out time is 10am. Guest may not reenter the premises to shower, change clothes, pack, etc. after check-out time. Guest shall vacate the premises at the end of the term unless sooner requested to vacate due to violation of restrictions set forth below. Maintenance/Owner/Agent may enter the premise for repair or inspection at any reasonable time.
Security Deposit / Linens – guests shall pay for security deposit as shown above. Guest must provide linens, towels and paper products.
Rules / Restrictions – no people other than those in the Guest party as set forth below may stay overnight in the property. The premises must be occupied by the guests identified below and all occupants of the premise shall be supervised by guest. Guest must be a financially responsible adult. Occupants shall not exceed the number of persons identified above. The premises shall be used for residential purposes only. No animals of any type shall be kept or permitted on the premises. Occupants shall not cause or allow activities on the premises to disturb the neighbors. Furnishings are not to be rearranged. All appliances, equipment, plumbing and other fixtures shall be used carefully and for legitimate purposes only. No alterations, additions or changes to the premise shall be made. No barbecue type cooking on the premises including balconies. Pool use is not guaranteed. No oversized vehicles on premise, some vans will not fit under the parking garage areas. Trailers prohibited on the premise and streets. Agent/Owner has no control over the onsite parking. Occupants shall not cause or allow loud or excessive noise, music, or other sounds to be made in the premises. Ocean City has adopted a noise control ordinance that makes it unlawful to cause or permit noise levels which exceed those established by the Department of Health and Mental Hygiene of the state of Maryland (comar 10.20.01). Upon notification that these noise levels have been exceeded as a result of activity on the premises, guest shall vacate the premises. Toilets; do not flush anything other than toilet paper. No feminine products should be flushed at any time. If it is found that any foreign items have been flushed and clog the system, you will be charged damages. Smoking is not allowed in the unit.
Initial DATE:
Damages / Security – the premises shall be vacated at the end of the term in as good order and condition as the premise was in at the start of the term. Guest shall be liable for damage to the premises or any property herein. Upon occupancy, guest must give Owner/Agent a list of existing damage within 12 hours after checking-in to avoid responsibility for previous damages. If any of the deposit is being withheld due to not complying with the terms of contract, requiring excessive cleaning or for damages to the property, the guest will be advised orally after check-out or in writing within 30 days thereafter.
Order to Vacate – Guest and other occupants shall vacate the premises promptly upon order of Agent, Owner, Condo’s HOA, Maintenance or Police. All occupants who refuse to vacate the premises at the end of the term or upon demand of the Agent, Owner, Condo’s HOA, Maintenance or Police shall be considered trespassers and subject to arrest and prosecution as such. Occupants who remain in the premises beyond the check-out time shall pay Owner/Agent $50 for the first hour (or portion thereof) and $75 for each extra hour (or portion thereof) beyond check-out time Occupants property left in the premises after the premises are vacated may be disposed of by the Owner/Agent in any manner without liability. Owner/Agent are not responsible for theft.
Cancellation and Transfer Refund – failure of guest to pay balance due by due date shall authorize Owner/Agent to make the premise available for other guests and retain all funds. All cancellations and transfers are charged 25% of the lodging rate. Any cancellation within 30 days of the check-in must re-book at the full rate otherwise the entire payment is forfeited. A signed agreement is not required for enforcement of cancellation policy. Owner/Agent reserves the right to cancel this agreement for good cause at any time, in which prevents Agents liability, if any, shall be limited to security Deposit received from guest. Owner/Agent shall not be liable for any mechanical failure in the premises or appliances therein during the occupancy term. However, Owner/Agent shall take responsible actions to correct such failures. No refunds will be given for mechanical failures. Guest misrepresentation of any fact in connection with this agreement shall entitle Owner/Agent to cancel and retain all funds. No refunds will be given for inclement weather including hurricanes.
Legal Actions – if guest breaches this agreement, guest shall be obligated to reimburse Owner/Agent of the premise for all costs including; reasonable attorney fees, all actions reasonable necessary to protect the Owner’s/Agent’s interests herein under. The parties agree that any litigation involving this Agreement or guest’s occupancy of this premise will be maintained in Worcester County, Maryland and guest waives any venue objection they may otherwise have. A $25 fee charged for returned checks.
Agency Funds – funds received by Owner/Agent shall be disbursed in accordance with this agreement. Owner/Agent shall not be obligated to deposit any funds in a trust, escrow or other special accounts and Owner/Agent shall not be obligated to pay guest interest on any funds received.
Indemnity/Hold Harmless – guest shall indemnify agent and the owner of the premises and hold them harmless on account of the property damage, personal injury or other financial loss caused by guest or other occupants of the premises. Agent and Owner are not responsible for problems which relate to a medical condition of an occupant and guest occupant must exercise their own judgment selecting unit.
Beach Replenishment – the Army Corps of Engineers maintains the beach through the replenishment program. Unexpected inconvenience may result without compensation.
Agreement – this Agreement constitutes the entire agreement and no other oral, implied or inferred representations, agreements or promises have been made by Owner or Agent unless otherwise expressly stated herein.Any Violation of any of the previsions of this lease agreement will result in Security deposit forfeiture.
Parking Passes – (Parking passes NOT in use at this time, 2 reserved spots) parking pass is located inside the unit. Renters must display parking pass on the rear view mirror at all times. Failure to display will result in towing of vehicle at renter’s expense. Leave the parking pass inside the unit upon departure of your stay. Missing parking passes will result in a $125 dollar per pass replacement charge. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

As part of the rental agreement or lease for a unit at Sunset Beach Condominium, the understand and agree that:
The Sunset Beach Condominium Declaration, Bylaws and Rules and Regulations control and govern the use and occupancy of the unit, and those documents subject each occupant to the fines for violations of the Declaration, Bylaws, or Rules and Regulations.
Each occupant must pay for all damages to or destruction of condominium property caused by the occupant or his/her guests; and
Sunset Beach Condominiums Association may order the occupants and guests to vacate the unit and leave Sunset Beach Condominium for substantial or repeated violations of the Sunset Beach Declaration, Bylaws, and Rules and Regulations.

This is a NON-SMOKING, six (8) person maximum unit. A violation of this policy, will result in Security Deposit forfeiture.
